Default Moving with NFA items?

What are the rules around this?

Do I need to notify the ATF? If so, it is done when the address changes or only when one moves out of state?

Thanks.

Yes you need to fill out a ATf form 5320.

Google search could have yielded results in 1.5 seconds

It took about 3 weeks for me to get my form back after emailing it in.

Nice to know, but - by law - you do not need any response from Washington.

You can submit the form and go.

If it's an in state move, you have no duty, no obligation, and in fact no process to notify them of the move. If it's an out of state move, you need a form 20 for each NFA item.

Off topic but related. Can u store an nfa item in a state that isnt your home state? Can you use the same trust for items in stored in separate states? Or do all your items need to be on the same trust and stored in the same state unless you notify the ATF.

Scenario is eventually storing cans and sbs at bug out area in a separate state while keeping other cans and prob sbr or two at home.

Thx

I do not believe this to be correct.

https://www.guntrustlawyer.com/form20

the most current 5320.20

Of course, you could skip any internet speculation and call the NFA branch directly with your questions.

I don't get legal advice from gun trust lawyer. I go straight to the source.

https://www.atf.gov/firearms/qa/i-ha...g-what-do-i-do

Application to Transport Interstate or to Temporarily Export Certain National Firearms Act (ATF Form 5320.20)

It's important to remember, our laws tell us what is illegal. Therefore if it's not in the law, then it must by default be legal. In this case, there is no law regardimg an in state move of an NFA item.

Thansk for links folks, very helpful. The gun trust lawyer link above suggests that it is now Instructions to the Form 4 that requires notification of in state moves.

This new or amended instruction should have been published as a proposed and then a final federal rule prior to its inclusion on Form 4.

This is where we should find some guidance from ATF itself. In one of those fed docs proposing and adopting the rule change. As well as the actual language of the instructions of Form 4 itself of course.
