Amendment to the

“Cook County DEADLY WEAPONS DEALER CONTROL Ordin ance”



WHEREAS, the Federal assault weapons ban, of the Violent Crime Control and Law Enforcement Act of 1994, as amended, 18 USC Sec. 921 et seq. expired on September 13, 2004; and



WHEREAS, the County Board desires to (1) amend Ordinance 93-O-37, as amended by Ordinance 93-O-46 and Ordinance 99-O-27, Article I, Section 1-2 by striking and deleting language in section 1-2; and (2) amend Ordinance 93-O-37, as amended by Ordinance 93-O-46 and Ordinance 99-O-27, Article VI, by deleting and adding language as stricken through and underlined below.



NOW, THEREFORE, PURSUANT TO THE HOME RULE AUTHORITY OF THE COOK COUNTY BOARD OF COMMISSIONERS, AS VESTED IN IT BY THE ILLINOIS CONSTITUTION OF 1970, HEREBY AMEND PORTIONS OF THE ORDINANCE, AS FOLLOWS:



ARTICLE I. GENERAL PROVISIONS



Section 1-2 Applicability.



(a) This article shall control the licensing of all firearms dealers within Cook County except in home rule municipalities which have a separate municipal ordinance specifically regulating the licensing of firearms dealers.



(b) Pursuant to Article VII, Section 6(c) of the 1970 Constitution of the State of Illinois, if this article conflicts with an ordinance of a home rule municipality, the municipal ordinance shall prevail within its jurisdiction.



ARTICLE VI. ASSAULT WEAPONS BAN



Section 6-1 Definitions.



As used in Article VI of this Ordinance, the following terms shall have the following meaning:



(a) “Assault weapon” means:



(1) A semiautomatic rifle that has the capacity to accept a large capacity magazine detachable or otherwise and one or more of the following:





(A) Only a pistol grip without a stock attached;



(B) Any feature capable of functioning as a protruding grip that can be held by the non-trigger hand;



(C) A folding, telescoping or thumbhole stock;



(D) A shroud attached to the barrel, or that partially or completely encircles the barrel, allowing the bearer to hold the firearm with the non-trigger hand without being burned, but excluding a slide that encloses the barrel; or



(E) A muzzle brake or muzzle compensator;



(2) A semiautomatic pistol or any semi-automatic rifle that has a fixed magazine, that has the capacity to accept more than 10 rounds of ammunition;



(3) A semiautomatic pistol that has the capacity to accept a detachable magazine and has one or more of the following:



(A) Any feature capable of functioning as a protruding grip that can be held by the non-trigger hand;



(B) A folding, telescoping or thumbhole stock;



(C) A shroud attached to the barrel, or that partially or completely encircles the barrel, allowing the bearer to hold the firearm with the non-trigger hand without being burned, but excluding a slide that encloses the barrel;



(D) A muzzle brake or muzzle compensator; or



(E) The capacity to accept a detachable magazine at some location outside of the pistol grip.



(4) A semiautomatic shotgun that has one or more of the following:



(A) Only a pistol grip without a stock attached;



(B) Any feature capable of functioning as a protruding grip that can be held by the non-trigger hand;



(C) A folding, telescoping or thumbhole stock;



(D) A fixed magazine capacity in excess of 5 rounds; or



(E) An ability to accept a detachable magazine;



(5) Any shotgun with a revolving cylinder.



(6) Conversion kit, part or combination of parts, from which an assault weapon can be assembled if those parts are in the possession or under the control of the same person;





(7) Shall include, but not be limited to, the assault weapons models identified as follows:



(A) The following rifles or copies or duplicates thereof:



(i) AK, AKM, AKS, AK-47, AK-74, ARM, MAK90, Misr, NHM 90, NHM 91, SA 85, SA 93, VEPR;



(ii) AR-10;



(iii) AR-15, Bushmaster XM15, Armalite M15, or Olympic Arms PCR;



(iv) AR70;



(v) Calico Liberty;



(vi) Dragunov SVD Sniper Rifle or Dragunov SVU;



(vii) Fabrique National FN/FAL, FN/LAR, or FNC;



(viii) Hi-Point Carbine;



(ix) HK-91, HK-93, HK-94, or HK-PSG-1;



(x) Kel-Tec Sub Rifle;



(xi) Saiga;



(xii) SAR-8, SAR-4800;



(xiii) SKS with detachable magazine;



(xiv) SLG 95;



(xv) SLR 95 or 96;



(xvi) Steyr AUG;



(xvii) Sturm, Ruger Mini-14;



(xviii) Tavor;



(xix) Thompson 1927, Thompson M1, or Thompson 1927 Commando; or



(xx) Uzi, Galil and Uzi Sporter, Galil Sporter, or Galil Sniper Rifle (Galatz).



(B) The following pistols or copies or duplicates thereof:



(i) Calico M-110;





(ii) MAC-10, MAC-11, or MPA3;



(iii) Olympic Arms OA;



(iv) TEC-9, TEC-DC9, TEC-22 Scorpion, or AB-10; or



(v) Uzi.



(C) The following shotguns or copies or duplicates thereof:



(i) Armscor 30 BG;



(ii) SPAS 12 or LAW 12;



(iii) Striker 12; or



(iv) Streetsweeper.



(b) “Assault weapon” does not include any firearm that has been made permanently inoperable, or satisfies the definition of “antique firearm,” stated in this Ordinance, or weapons designed for Olympic target shooting events.



(c) “Detachable magazine” means any ammunition feeding device, the function of which is to deliver one or more ammunition cartridges into the firing chamber, which can be removed from the firearm without the use of any tool, including a bullet or ammunition cartridge.



(d) “Large capacity magazine” means any ammunition feeding device with the capacity to accept more than 10 rounds, but shall not be construed to include the following:



(1) A feeding device that has been permanently altered so that it cannot accommodate more than 10 rounds.



(2) A 22 caliber tube ammunition feeding device.



(3) A tubular magazine that is contained in a lever-action firearm.



(e) “Muzzle brake“ means a device attached to the muzzle of a weapon that utilizes escaping gas to reduce recoil.



(f) “Muzzle compensator” means a device attached to the muzzle of a weapon that utilizes escaping gas to control muzzle movement.



Section 6-2 Assault weapons and large capacity magazines - Sale prohibited - Exceptions.



(a) No person shall manufacture, sell, offer or display for sale, give, lend, transfer ownership of, acquire or possess any assault weapon or large capacity magazine. This subsection shall not apply to:





(1) the sale or transfer to, or possession by any officer, agent, or employee of Cook County or any other municipality or state or of the United States, members of the armed forces of the United States; or the organized militia of this or any other state; or peace officers to the extent that any such person named in this subsection is otherwise authorized to acquire or possess an assault weapon and/or large capacity magazine and does so while acting within the scope of his or her duties;



(2) transportation of assault weapons or large capacity magazine if such weapons are broken down and in a non-functioning state and are not immediately accessible to any person.



(b) Any assault weapon or large capacity magazine possessed, sold or transferred in violation of subsection (a) of this section is hereby declared to be contraband and shall be seized and disposed of in accordance with the provisions of Section 6-2 of this Ordinance.



(c) Any person found in violation of this section shall be sentenced to not more than six months imprisonment or fined not less than $500.00 and not more than $1,000.00, or both.



(d) Any person who, prior to the effective date of the ordinance codified in this Ordinance, was legally in possession of an assault weapon or large capacity magazine prohibited by this section shall have 90 days from the effective date of the ordinance to do any of the following without being subject to prosecution hereunder:



(1) To remove the assault weapon or large capacity magazine from within the limits of the County of Cook; or



(2) To modify the assault weapon or large capacity magazine either to render it permanently inoperable or to permanently make it a device no longer defined as an assault weapon or large capacity magazine; or



(3) To surrender the assault weapon or large capacity magazine to the Sheriff or his designee for disposal as provided below.



Section 6-3 Destruction of weapons confiscated.



Whenever any firearm or large capacity magazine is surrendered or confiscated pursuant to the terms of this Ordinance, the Sheriff shall ascertain whether such firearm is needed as evidence in any matter.



If such firearm or large capacity magazine is not required for evidence it shall be destroyed at the direction of the Sheriff. A record of the date and method of destruction an inventory or the firearm or large capacity magazine so destroyed shall be maintained.

AN ORDINANCE AUTHORIZING THE PUBLIC APPROVAL OF THE ISSUANCE OF CERTAIN COLLATERALIZED SINGLE FAMILY MORTGAGE REVENUE BONDS AND CERTAIN DOCUMENTS IN CONNECTION THEREWITH; AND RELATED MATTERS



WHEREAS, pursuant to Section 6(a) of Article VII of the 1970 Constitution of the State of Illinois, The County of Cook, Illinois, is a political subdivision and a home rule unit of government duly organized and validly existing under the Constitution and the laws of the State of Illinois (the “County”); and



WHEREAS, pursuant to Section 10 of Article VII of the 1970 Constitution of the State of Illinois and the Intergovernmental Cooperation Act (5 Illinois Compiled Statutes 2004, 220/1 et seq., as supplemented and amended), public agencies may exercise and enjoy with any other public agency in the State of Illinois any power, privilege or authority which may be exercised by such public agency individually, and, accordingly, it is now determined that it is necessary, desirable and in the public interest for the County to enter into an Intergovernmental Cooperation Agreement (the “Cooperation Agreement”) dated as of April 1, 2005, by and among the County and certain other units of local government named therein (the “Units”), as from time to time supplemented and amended, to aid in providing an adequate supply of safe, decent and sanitary residential housing for low and moderate income persons and families in such Units (the “Program”); and



WHEREAS, to provide for the Program, the City of Aurora, Kane, DuPage, Will and Kendall Counties, Illinois (the “Issuer”), proposes to issue, sell and deliver its Collateralized Single Family Mortgage Revenue Bonds in an aggregate principal amount not to exceed $500,000,000 (the “Bonds”) in one or more series to obtain funds to finance the acquisition of mortgage-backed securities (the “GNMA Securities”) of the Government National Mortgage Association (“GNMA”), evidencing a guarantee by GNMA of timely payment, the acquisition of mortgage‑backed securities (the “FNMA Securities”) of the Federal National Mortgage Association (“FNMA”), evidencing a guarantee by FNMA of timely payment, and the acquisition of mortgage-backed securities (the “FHLMC Securities”) of the Federal Home Loan Mortgage Corporation (“FHLMC”), evidencing a guarantee by FHLMC of timely payment, of monthly principal of and interest on certain quali fied mortgage loans under the Program (the “Mortgage Loans”), on behalf of the County and the other Units all under and in accordance with the Constitution and the laws of the State of Illinois; and



WHEREAS, a notice of combined public hearing with respect to the plan of finance of the costs of the Program through the issuance of the Bonds has been published in The Chicago Tribune, a newspaper of general circulation in the County, pursuant to Section 147(f) of the Internal Revenue Code of 1986, as amended (the “Code”), on August 24, 2006, and appropriately designated hearing officers of the City of Aurora, Kane, DuPage, Will and Kendall Counties, Illinois, the City of Belleville, St. Clair County, Illinois, the City of Champaign, Champaign County, Illinois, and the City of East Moline, Rock Island County, Illinois, have conducted said combined public hearing on September 13, 2006.



NOW, THEREFORE, BE IT ORDAINED BY THE COUNTY BOARD OF THE COUNTY OF COOK, ILLINOIS, AS FOLLOWS:





Section 1. That it is the finding and declaration of the County Board of the County that the issuance of the Bonds by the Issuer is advantageous to the County, as set forth in the preamble to this authorizing ordinance, and therefore serves a valid public purpose; that this authorizing ordinance is adopted pursuant to the Constitution and the laws of the State of Illinois, and more particularly Section 6(a) of Article VII of the 1970 Constitution of the State of Illinois, Section 10 of Article VII of the 1970 Constitution of the State of Illinois and the Intergovernmental Cooperation Act; and that, by the adoption of this authorizing ordinance, the County Board of the County hereby approves the issuance of the Bonds for the purposes as provided in the preamble hereto, the text hereof and the notice of public hearing referred to in the preamble hereto, which notice is hereby incorporated herein by reference, and the conduct of the combined public hearing referred to in the preamble hereto, which public approval shall satisfy the provisions of Section 147(f) of the Code.



Section 2. That the form, terms and provisions of the Cooperation Agreement be, and they are hereby, in all respects affirmed.



Section 3. That the President of the County Board, the County Clerk and the proper officers, officials, agents and employees of the County are hereby authorized, empowered and directed to do all such acts and things and to execute all such documents and certificates as may be necessary to carry out and comply with the provisions of the Cooperation Agreement and to further the purposes of this authorizing ordinance, including the preamble to this authorizing ordinance.



Section 4. That all acts of the officers, officials, agents and employees of the County heretofore or hereafter taken, which are in conformity with the purposes of this authorizing ordinance and in furtherance of the issuance and sale of the Bonds, be, and the same hereby are, in all respects, ratified, confirmed and approved, including without limitation the publication of the notice of public hearing.



Section 5. That the Issuer hereby transfers to the issuer of the Bonds, and hereby allocates to the issuance of the Bonds, its volume cap for calendar year 2006 in the amount of $5,000,000.00 which volume cap has not been transferred or allocated to any other issue; and that the President of the County Board is hereby authorized to request unified volume cap from the Office of the Government of the State of Illinois for the Program in each of the years of 2007, 2008 and 2009, which unified volume cap, if received by the County from the Office of the Governor of the State of Illinois for the Program, will be allocated to the issuance of the Bonds upon the written direction of the President of the County Board of the County; and that the County, by the adoption of this authorizing ordinance, hereby represents and certifies that such volume cap has not been allocated to any other bond issue or transferred back to the Office of the Governor or otherwise.



Section 6. That this authorizing ordinance shall be and remain irrepealable until the Bonds and the interest thereon shall have been fully paid, cancelled and discharged.



This Ordinance shall be effective upon passage.



Approved and adopted this 14th day of November 2006.

Illinois blows, Midwest F-ing blows. My sperm donor lives up there and I've been to visit many times, You all can have each other. No it won't sweep, not all local govs are not that f-ing stupid. Cook Co. got what it deserved. As I said before there are way too many wasted bullets in this country.

I don't mean to be nasty. I've spent enough time in the Chicago area to know I'll never go back. Also I've driven through Indianapolis and Cincinnatti Ohio, these cities left a lasting impression on me. Southern states not including Florida are thriving for a reason.

Unfortunately the sportsmen and shooters in Illinois obviously don't support each other enough to prevent such crap. I left my guns at home whn I travelled through there last week in fear of arrest for having an "assault rifle". Soon there will be a semi and a pump action ban there. "Of the people, by the people!" Stand up for your rights Illini shooters! Vote them out of power!

I find it funny that guns are banned in states like this but there are manufacturers making these firearms in those states. DSA comes to mind as they are based out of Illinois but probably not this county. Colt is based in Conneticutt and there are bans there too. Why do they continue to give those states there business in tax dollars? I am sure the cost to move a plant would be tremendus but.....well you know what i am talking about here.

I will never understand the thinking of these people who believe that banning "assult" type weapons will ever have any effect on crime. I have nothing base this on other than my imagination but I would think that a 12 gauge riot gun loaded with six rounds of 00 Buck may do more damage to a crowd of 100 in short order than an AK with a 30 round mag. And when was the last you heard of a 7-11 being robbed with an AK or AR?

Against Cook County Gun Ban


CHICAGO, Feb. 21 /PRNewswire-USNewswire/ -- The following was released today by the Illinois State Rifle Association (ISRA):

The ISRA announced today that it is seeking injunctive relief against a gun ban recently enacted by the Cook County Board. In filing its complaint with the Cook County Circuit Court, the ISRA is asserting that compliance with the vaguely-worded ordinance would be impossible for most citizens of Cook County and, further, the method by which the ban was passed violated the Illinois Open Meetings Act.

On November 14, 2006, the Cook County Board passed an amendment to the existing Cook County Deadly Weapons Dealers Control Ordinance which seeks to ban the sale, possession and transfer of a variety of popular hunting and sporting firearms. The amendment, authored by Commissioner Larry Suffredin, had been tabled in July of 2005 by the Board.

"In light of the circumstances under which this amendment was passed, the ISRA felt it was important that action be taken to halt its implementation," said ISRA Executive Director, Richard Pearson. "We are disappointed that the Cook County Board chose to pass this ordinance without benefit of public debate -- especially when its provisions impact such a large number of Cook County residents. In addition to the questionable procedures under which it was passed, the ordinance is so poorly worded that few, if any, firearm owners in the county would be certain that they were in compliance with its requirements."

"We are confident that the Cook County Circuit Court will recognize the shortcomings of this ordinance and grant the firearm owners of Cook County an injunction against its implementation," continued Pearson. "The ISRA and the firearm owners of Cook County are second to none in their desire to eradicate violent crime. However, we do not believe that law abiding firearm owners should take it on the chin in the process. The ISRA and its members stand ready to provide advice and guidance to the Cook County Board in the development of meaningful legislation that will fight violent crime while preserving the rights of law-abiding citizens who choose to own firearms."

I agree but what do you propose? There are more people all the time but not enough to get a wave of revolt going. What's missing in part is leadership and there is no one out there with the leadership ability who is willing to sacrifice it all for freedom and country.

The people who we discuss here are greater enemies to our freedom and the Constitution than all of the foreign enemies we possess.

This u.s. unsupreme court could take a gun issue and solve this once and for all and restore the 2nd amendment and the u.s. constitution(R.I.P.). They are mostly appointed by a republican (i think) and they do.....nothing. Revolution should be last, and we have options before this last choice. Try voting third party since the other two are bought and paid for already. If nothing else it increases the cost of purchase and then we can say we tried and not "waste lead" as another commenter wrote. republicans, republicans our only salvation-true they have not set back gun issues currently, but have they done anything?? American indians made terrible slaves-they chose to die first. Lets try to and be brave.

voting and demoCRAPcy is whats gotten us in this mess. what happens when cowards and fools outnumbered real Americans? if something doesnt shake soon, we're all screwed. theyve been planning this for decades. they will starve us out, or outlaw guns then arrest us when the guns arent turned in. if a handfull of people stand up, they may make noise but no one will join the Revolution, and said Revolutionaries will be dismissed as outlaws. we're screwed.

Please note that SINCE the cook county 'assault weapon' ban, murders have gone UP in Chicago rather than down.

What do you expect??? Take the firearms away from Lawabiding Citizens and only criminals have them. The 2nd amendment only exists as our Founding Fathers KNEW that it was extremely important to keep government honest. Now we have to deal with what is handed down to us..........

Those who introduced it DON'T CARE how many are killed because of the ban, nor do they care that depriving the law abiding of the means to defend themselves has ALWAYS lead to more crime.

What they care about is social control & removing the means available for citizens to defend themselves against an out of control government, whether Federal, State or local.

Just for fun, since this is a sticky and I'm not really necroing an old post:

Can anyone see any laws in the above that would ban an RPK with a fixed wood butt stock and the upper and lower front handguards removed fired with a welding glove on the forward hand? That seems to neatly circumvent all the laws even with a 75 round drum in it because the RPK isn't named on the list and they used the word "and" in a very stupid spot on their rifle checklist.

(1) A semiautomatic rifle that has the capacity to accept a large capacity magazine detachable or otherwise >and< one or more of the following:

(A) Only a pistol grip without a stock attached; (rpk with fixed stock)

(B) Any feature capable of functioning as a protruding grip that can be held by the non-trigger hand; (no forward pistol grip and you could even remove the bipod and carry handle if they want to be anal)

(C) A folding, telescoping or thumbhole stock; (again, fixed wood stock)

(D) A shroud attached to the barrel, or that partially or completely encircles the barrel, allowing the bearer to hold the firearm with the non-trigger hand without being burned, but excluding a slide that encloses the barrel; or
(remove all forward wood and use heavy high heat gloves)

(E) A muzzle brake or muzzle compensator; (rpk with muzzle nut)

They do use "but not limited to" in their named rifle list:
(7) Shall include, but not be limited to, the assault weapons models identified as follows:
But since my theoretical modified RPK is not an assault weapon by their above definition, it should be exempt from that statement.

Its all semantics but then that's what laws are.
