Default Pistol lower?

Excuse my ignorance. Building an AR pistol with a brace. For it to be legal do I need to buy a pistol stamped lower or can I use any lower?

Any virgin receiver can be made into a handgun or long gun, according to federal law. Markings mean nothing.

Some state & local laws are what require "pistol" markings.

All the stripped AR lowers I've used for pistol builds were marked as 'other' on their paperwork by the FFL. I also keep the receipt just to prove it was purchased that way.

I've been told that any complete lower, whether it's got a stock or a brace/tube on it should be 'other' as well. It doesn't become a rifle, pistol or SBR til it has an upper attached. So the only lower that should be registered as a rifle would be one sold as a complete rifle.

I like to err on the side of caution as I'm not a lawyer and start with a virgin receiver for pistol builds. years ago I bought a Kel Tec PLR-16, a pistol that takes AR 5.56 mags. The FFL wrote it up as a rifle at first, I pointed it out and he re-did the paperwork. I know that's on the FFL to do it right but I'd rather not get in the middle of that.

It doesn't matter what the FFL writes in their books.

What matters is how the manufacturer shipped it out.


This came up quite a lot before "other firearm" became part of the 4473, but the bottom line is "a virgin receiver is a virgin receiver, regardless of how a FFL marks it in his books" )
