Help! I have a 308 Saiga that I want to sell, and I keep getting comments that it has to have parts/changes to make it legal! It is straight out of the box, 308, wood stock, unfired, from Ishmash factory, with 8rd mag. What's the straight poop?

If it is in the configuration it was in when it was imported, it's legal. Only when you start re-configuring it does 922(r) apply.

$550 + shipping would get it gone.

long or short barrel. Why are you selling it?

Kernel, don't you have to comply with 922 when using hi-capacity mags in it?They are imported for sporting purposes with 10 round mags only.td
PS if I remember correctly this gun was pictured with 2 hi-capacity mags

Yes, you do have to comply with 922r.
You cannot use a "non sporting" magazine in a factory (unmodified) Saiga rifle. "Non sporting" = 11 rounds capacity or more, and commonly misrepresented as "hi-capacity" (they are not).
The act of inserting a "non sporting" magazine instantly changes the legal status of such a rifle into "non sporting" (and thus non-importable) and is a felony.
Not my laws. Just sayin' how it is.

Strange. Then why do most dealers sell them with hi-cap mags included? Including many/most online dealers?

Because it's not illegal to sell them that way?
C'mon now, your car will exceed the speed limit. Why don't the car manufacturers put governors on them?
And just about anything from the tool aisle at the home improvement store can be used for MURDER - why are such things sold?
It's called "personal responsibility".

No such thing anymore. We all apparently need to be told what/how/when/why before we do anything.
Back on topic, good luck with the sale. If you've got "hi caps" just sell em seperate. Prob make more money that way anyway.
