View Thread: Michigan gun owners - a question...
MICHDAD3
I live in Michigan, am a little unsure and could use some clarification by anbody that might know. I have a Yugo M70 with an underfolding stock that I built from a parts kit and a Nodak Spud Model NDS-M92 Yugo underfolder receiver. I was told by the Michigan State Police in Lansing that I needed to register this gun as a pistol because it could be fired when the stock was in the folded position. I took some measurements and here's what I came up with:
Barrel - 16 1/4"
OAL (when stock is extended) - 35"
Folded length - 26"
So, does this gun definately need to be registered as a pistol? Why?
If so, what would be the mag requirements to use this gun for hunting? If this gun is deemed as a 'pistol' are there mag limit requirements for hunting with a pistol?

IIRC, MI state law says a "pistol" is any gun under 30" overall length and they measure a rifle with the stock folded. Underfolding AKs qualify.
Also, are you measuring with the muzzle device removed? MI measures the overall length with the stock folded, if it falls under 26" they consider it an illegal SBR. Feds measure with stock extended, so it is not an issue with them.
No idea on the huntng regs.

Krink is correct, I live in Shitigan and it has to be registered as a pistol and sold as a pistol. Fom the longest point when folded, pistol grip with muzzle brake removed. No AMD 65 or krinks at all as we are a no SBR state, unless built without stocks, as a pistol.

good luck michdad,
even the police depts, including the staties, don't know the "rule" of thumb! I know this well, as had called the AG on serveral occasions and they weren't clear on it. BTY, I can't find one instance of the rule ever having been enforced. Visit us at http://www.migunowners.org/ to help you with questions.

I will chime in and second Swoop. The Law is very unclear. What is written law is that anything less than 30" folded is a pistol and must be registered as such. There is currently an AG's opinion that any rifle with a folding stock whose overall length folded is less than 26" (not including any removeable muzzle device) is a SBR regardless of the length of barrel.
Technically, you can own the weapon as the AG's opinion is just that, his opinion. However should a LEO take issue with your weapon and you end up in court the odds of you winning are not good as the AG's opinion carries significant weight. The law was cloudy enough that most major arms sellers were/are unwilling to carry arms that were less than 26". Williams Gunsight is an exception to the rule and has carried them pretty regularly.
Just not worth the risk if ya ask me.

I live within five miles of the MI border and considered moving there initially when I moved up here and considered moving there again afterwards. Also considered doing so when I retired.
It is this ridiculous crap that kept me from doing so each time and will keep me from doing so in the future.
Damn MI gun laws are like a freakin' phone book. Not worth trying to figure it all out.
Then there is their wonderful no fault auto insurance.
I'll just pass.
WI doesn't have CCW but I can have just about whatever I want and where I live, I open carry whenever I want which is mostly.

I wasn't aware of the law till recently I noticed a Dunham's sale flier with a AMD-65. And it said not available in MI under the AMD-65. So I did a little research and found out the stupidity........

Well you can have AMD65's in Michigan....you just have to do them a little different.
Usually when making a AMD65, you need to perminately attach the muzzle devise to make the 16" minimum barrel length anyhow, well the way most people get around the SBR's is to buy a extended muzzle devise and perminate and attach it onto the barrel anyhow.
Well in Michigan there are places that make a 1/2" +/- longer muzzle devise that we attach to the barrel to make the AMD65 26 1/8" OAL and simply register it as a pistol..(NO we dont have to pin the stock in the folding position)..that's the only real odd-ball thing we got going, there's fix's for most problems you just got to put your mind to it basically.
I was actually going to put a 1/8" metal dowel pin out the back of my trunion to extend my extra 1/2" for OAL because I already purchased my extended muzzle break for the barrel. Or I was going to see if i could possibly put some kind of sling swivel off the back of the trunion to extend that 1/2" or so...
So you are correct, you really can't buy a factory AMD65 in a box store in Michigan. You have to building it yourself or have a quality builder who is familar with the laws build one for you and registering it like a pistol. I'll probably start my build in the spring and see how it goes.
And as far as CCW and open carry....Yea, open carry has been in Michigan for a long-long time but it has been a cloudy ruling, but the CCW laws definately make it pretty cut and dry and within the persons right to carry--every state deserves the right!...Imagine a CCW AMD65!..WOW

Michigan-where the job base is shrinking and the welfare cases are increasing. The educated population is moving out of state and the uneducated population is growing.Govenor is a canadian with a mole on her face the size of Rhode Island.Inner cities look like a war zone and the rural area is breathtaking. So many gun laws not even the cops and courts know them all.And if you don't like the weather hang around, it will change.
