View Thread: Type 7 FFL and residence requirement
pabiron1
Has anyone applied for a type 7 FFL before? I asked the ATF for an application. I like to build 3 or 4 AK's a year, to sell. I want to make sure everything is legal.
I am concerned about the residence requirement.I live in a condo, with no separate business entrance.
How have others met this requirement?
Thanks!

pabiron1, you living in a condo isn't going to fly for any FFL, other then a 03 C&R. the area where you will be conducting business has to be commercial zoned, and that has always been on the books, but was never really enforced until clinton became president, so the era of "kitchen table dealers" has been dead for a long time now ............now there are exceptions........if you live out in the sticks, or in a area that does not restrict a commecial enterprise running out of your house, but you must have a seperate entrance to them.......I know a few folks that have FFLs, one has a 01/class 3 SOT, and a couple of 07s, and they use their residence for business, of course with a seperate entrance..........in one case he lives in a township, in the others they live out in the sticks, basically out of the city limits, The township one is weird, it's a residental neigborhood, but people have signs for beauty parlor, well drilling services etc.. then there are houses that are built in commercial zoned area.
to be blunt about it........if you are going to do the necessary things to get a 07 licence just to build a couple of AK or whatever to sell yearly, you are nuts. the cost of the licnece fee, and the paperwork for that licence will far cost you more then any profits you will see.......add to that rent of a commercial space, and you will be out of business in less then a year with nothing to show for it but a big deficit in your bank account.
then, you will have to be incorporated by getting a LLC.........if you build something and it blows up in a customer's face, that is your fault......he or his family can sue the pants off you, and you will be living in a cardboard box under a overpass.

dump the condo and get a live/work type place. business downstairs, residence above.

If plying your trade requires you to succumb to unconstitutional laws and wallow in BATFE muck, the price should be too high.

i hate to say it but that may be sound advice. somehow i don't see a kinder, gentler atf under the present administration.
