I have an AMD-65 kit that I purchased over a year ago. I want to assemble the kit but I have problems with the measurements. I have a TAPCO AMD extended muzzle attachment that when soldered on will bring the barel length to 16-1/8" which would be legal but doing a rough measurement of the barrel and an NDS receiver, the overall length will be about 25" which is 1" less than the required overall length of 26".

The kit came with the side folder stock. MY QUESTION: Is the overall length considered to be from the extended muzzlebrake to the end of the stock when extended??? Of course the total length would be well more than 26" when extended but if folded the total length would only be around 25", which would be a short barrel rifle.

I have searched some threads but have only seen discussions of barrel lengths and the permanent attachment of muzzle devices to reach the 16" required. I cannot find anything on the folding stock counting in the overall length. Does the folding stock have to be permanently fixed in the open/extended position? Sure would like to assemble the kit but do not want to make an SBR out of it.

Would appreciate any info on this.

ATF sez measure with stock extended, so on a Fed level you are legal with the folder. MI (and possibly some other states or localities, laws do vary across the US) sez measure it with the stock folded, so you would have a problem there. Also, some states, Kali for one, passed their own version of the now defunct national AW ban, so a folder would be verboten in those jurisdictions as well, regardless of length.

Thanks for the reply Kernel Krink. You sure seem to be one of the xperts in the laws and other areas. I sort of figured that the overall for a rifle was measured with the stock extended but wasn't sure since the stock folds.

I looked on the ATF.gov site for info about folding stocks but did not find anything about measuring a rifle's overall with a folding stock extended or folded. Would you know which publication covers in more detail the measurement of overall length?

Thanks again, KernelKrink. I made a copy of that ATF letter in the reference link. I have looked through the Federal Firearms Regulations Reference Guide, dated 2005 and could not find a reference to overall length with a folding stock or side folder. Must be one of those things a person does not find out unless they make written contact with the ATF. I am going to go ahead and fix that AMD-65 kit that I have had on a shelf for sometime now.
