View Thread: Tax stamp paperwork.

What happens if you forget to take a copy of your tax paperwork with your Class III gun? Can they take your gun? Throw you in jail? Not that I would do it. I was just wondering what happens.
Thanks,
Rob

well if no LEO types ask to see the paperwork, you pretty much don't have to worry about, do you? since I have had my SBR for 3 years and have gone to ranges and shooting gatherings not one LEO type has asked to see my paperwork, probably due to them not knowing it's NFA weapon.

But I would imagine if you can't produce the paperwork when asked, they would most likely conficate the weapon and detain or arrest you....until you can prove the weapon isn't illegal. I don't know if there is a ATF NFA hotline where they can call and give your name and the serial number and model of weapon where they can get verification over the phone that it's a legal weapon

I just hope people are not dumb that they carry the original form 1 with the weapon. best to make a copy and keep the original in a safe place

ATF can't confirm an NFA registration to anybody but the owner or his legal representative without a court order. NFA tax forms are considered tax returns and are protected from disclosure just like a 1040 would be. From what I understand, if an LEO calls ATF with the serial number and owners info they just say "we have no problem with him owning that" if it is properly registered. Depending on state law and the LEO, that may be enough. However some states outright ban certain NFA weapons and then allow a "positive defense" that it is registered with the Feds. In that case no paperwork to show them and you will likely be arrested and charged until you can produce it. Best to keep multiple copies of all your ATF tax forms, one set in the gun safe, another in each vehicle, and another in any gun cases you may use to transport them. A few bucks spent copying forms could save a whole lot of trouble later on.

If you're bright enough to acquire NFA firearms, and wealthy enough to afford them, you aren't going to forget your form 4's when you go shooting

I'd suggest you make four copies. Keep one tucked above the sunvisor of every/both vehicles you own, one for your tools/parts box that you inevitably take with you every time you go shooting, and another for your safe, with the original. It's a no-brainer

When the Sheriff shows up, I approach HIM with paperwork in hand. I know why they're visiting

They've never scrutinized my F4's. And being the decent human being you are, always invite him to run a few mags or a belt or whatever. They seldom, if ever, refuse that offer

And everyone goes away feeling really good

Just curious, it sounds as though you get fairly regular visits from the Sheriff.

Any thoughts on why?

If you watch his videos youll figure out why.

Regular shoots, FA or not, around here the law would get tired of chasing down reports on a known law-abiding citizen.

Johnson -

The day those pics were taken, a CII friend from TN was visiting. He brought a Browning .50 M2, plus we had 3 other beltfeds mostly in 8mm. Things were much louder than usual, especially with the .50 M2 We figured it was just a matter of time before law enforcement would visit. They all left in a pleasant frame of mind

I used to shoot several hundred rds average per weekend, but with prices on ammo skyrocketing, am reining in the belt and budget

Ammo, gas, insurance & healthcare - suddenly it got very expensive just covering the basics

(M25) Does the owner of a registered NFA firearm have to have any evidence to show it is registered lawfully to him or her? [Back]

Yes. The approved application received from ATF serves as evidence of registration of the NFA firearm in the owner's name. This document must be kept available for inspection by ATF officers. It is suggested that a photocopy of the approved application be carried by the owner when the weapon is being transported.
