View Full Version : Are AK pistols legal in New York State?

Ive been considering building an AK pistol, so I got out my state regs.
A pistol is an 'Assault weapon' if it is -
semi auto and has any (2) of the following,
1) the ability to accept a magazine from a spot other than the pistol grip, (um, yep, AK pistols got that....) :(
2) Threaded bbl (Braze on a break, no problem here) :)
3) BBL shroud or covering for nonfiring hand (gotta have a handguard.) :(
4) unloaded weight of more than 50 oz (Im sure it does) :(
5) Any semi model of a full auto firearm (kinda a grey area, seeing how there are really no actual AK pistol models officially produced, but Im sure it is considered a semi variant of an AK) :(
Am I interpreting this wrong, or do they have me by the balls on this one, and there is NO way I can build a AK pistol in NY state?

the only way I think you might be able to have a pistol in NY state, is to do what hesse did during the 94 AW ban. weld in a mag, so that it is not detachable any longer, and braze on a muzzle device.
of cource I first would first check with your state AG to check my theory.......I can be way, way off here, so don't take it as legal advice.
also don't quote me, but I think that when they say "5) Any semi model of a full auto firearm" they could mean things like a shoulder fired machine pistol made into a pistol, like the skorpion.....again this is just my guess on that

I am saving my AMD65 kit and Polish folding kits to build when I get out of this BS state.
You would need to register it too!
NY State Police enforce all handgun laws so you might want to check there.

If you allowed to build an AK rifle,just go with a 16 inch barrel and no buttstock.That wouldn't be much longer than most AK pistols anyway.They aren't that small.

There is an overall length issue to be aware of. During the AWB, there was a small block made that fit in the rear trunion to meet minimum required overall rifle length.
In NY, we must still follow the old AWB rules...that is until the State Assembly and Liberal/Demos get their way and ban all guns here.

There is an overall length reg that is federal I think 27 or 27.5 inches.Some states have longer lengths such as California I think it's 30 inches.They make 18 inch barrels to replace the 16 inch barrel in Uzi carbines in California..The length includes the barrel and receiver not the buttstock or receiver insert.It has to be part of the barrel or part of the receiver.The barrel can be removable but not the extension.In Washington,D.C. shotguns have to have barrels no less than 20 inches long the federal reg is 18 inches.

remember, you have the right to refuse a search of ANY of your property if the cops dont have a warant, they try to trap you with that bullshit "probable cause" to save there asses a lawsuit, just say you studied law in college and you know your rights, and you will not give your consent to a search. ;) theyll leave.

its illegal if its has no stock, and a barrel of under 16", NY is pretty strict about gun laws, let alone a gun that is used by more terrorist's then any other...to be safe, keep with a folding stock and 16", you will probably get busted shooting that pistol, but hey, its not illegal if you dont get caught ;)

no folding stocks on a post-ban ak in NYS... if you're building an underfolder or amd-65 here, you have to weld the stock open. >:(
the pistol build is pretty much out because the mag is located outside of the PG anyway. *shakes fist at state*

Could you build a 1911, and how would you go about registering it and getting a pistol permit?

i'm fairly sure you'd have to get the permit first, and upon approval, assemble the gun and have it added to your permit. (might have to put the s/n on permit prior to assembly)

Nope, an AK pistol in NY State isn't unconstitutional.
Wait, that wasn't the question. Sounds completely "illegal".
