The family of murdered Border Patrol agent Brian Terry has filed a $25 million wrongful death suit against the Bureau of Alcohol, Tobacco, Firearms and Explosives claiming Terry was killed with AK-47s that were knowingly sold under the Fast and Furious gunrunning probe to a straw purchaser for drug cartels.

In a 65-page complaint, filed in Arizona state court on Wednesday, attorneys for the family claim ATF "wrongdoing" in Operation Fast and Furious.

“ATF's failures were not only negligent but in violation of ATF's own policies and procedures," the complaint claims.

The family has also filed a suit against the Lone Wolf Trading Company seeking unspecified damages for negligence in selling the weapons to the purchaser and aiding and abetting in Mexican drug cartels’ conduct.

The suit says Lone Wolf knowingly sold "hundreds of weapons" to various straw purchasers and in turn realized "hundreds of thousands of dollars in profits from these sales."

The suit alleges that "but for defendants' negligent and illegal sales ... Brian Terry would not have been murdered in the Arizona desert on Dec. 14, 2010."

The family is seeking a jury trial.

The government now has 60 days to respond or the Terry family will file the suit for the $25 million.

According to the claim, agent Terry was patrolling near Rio Rico on the night of Dec. 14, 2010 when he was shot and killed by criminals yielding assault rifles. Those rifles were traced to a straw purchaser for Mexican drug cartels in Arizona who the ATF knew about and allowed to deliver the weapons to the cartels.

“The murder of agent Terry and other acts of violent crimes were the natural consequence of ATF's decision to let dangerous weapons designed to kill human beings 'walk' into the hands of violent drug-trafficking gangs,” the complaint reads.

The claim also contends that the circumstances that led to Terry’s murder were not isolated events, but rather there were thousands of guns purchased under occasional ATF surveillance with no way of tracking all the weapons from straw purchases.

In a second claim filed against Lone Wolf Trading Company, the Terrys say the company should have recognized the illegal and risky nature of the purchases, but it instead ignored its legal obligation under federal and state law to refuse illegal firearm sales.

The company was not only aware that the purchases were illegal and part of the Fast and Furious operation, but it also knew the ATF did not arrest the purchasers and let the straw buyers continue to make illegal buys, according to the claim.

Both the ATF and Lone Wolf were unavailable for comment on Wednesday.


The family stated in their claim against the ATF that Christmas 2010 was to be the first the family was to spend together in three years because of Brian’s ATF duties. Brian was killed two days before he was to fly home to Michigan.







I would LOVE to be on that jury. I hope the family sinks the ATF. They shouldn't exist in the first place.

Maybe instead of profiteering from the death of their boy they should take more direct and appropriate action against the ATF? After all, it is our tax money that will be lining their pockets.

I'm another who would love to be a juror in that trial. I dont see any way in hell the family could lose. The ATF,Obummer and Holder need to be held accountable.

I don't get why the gunshop is included in the suit, every relevant document and testimony so far says the gunshop didn't want to sell these guns, ATF told them to. The gunshop owner was raising concerns about the guns getting away long before anyone in ATF blew the whistle. I would think having them as a cooperating witness for the plaintiff (maybe under threat of lawsuit if necessary) would get more damning testimony and evidence against ATF than makeing them a defendant.

For sure, I would prefer my tax money going to that family and see some ATF heads roll, verses drop it, let it go, continue status quo, and give all my money to solindra and O-dumbshits buddies. At least this way some justice will be served and it will make it hard for those assholes to remain unaccountable.

Years ago when I tried to suit the ATF, I was told by my attorney that the ATF could NOT be suited. Down heartening to say the least. After all, the ATF had tried to put me in prison on phoney charges. The charges also damaged my reputation.

The charges are still on the police record. They will never come off, either.

I say good for them. I hope they get it. I would do the same, not for the money but the truth to come out. This trial, if it takes place will help keep this government crime in the limelight and may bring new info that had been covered up. Witness's will have to testify. This is probably the reason behind naming the gun store in the lawsuit as well. If the gun store was "following orders" under protest....fine, but let's hear exactly how they were strong armed by these goons under threat and who ordered it.

I'm betting they will donate the money if they win to charity in Brian's name. I'm guessing its not about the money, its about the crime that took place and bringing this government abuse of power to light for the world to see.

I just wish it were a criminal trial.

I also see where the suit in and of itself continues to make what happened continue to be discussed with the hope it will lead to convictions of those in power with blood on their hands.

I totally agree on that,as long as their hands were tied leave them out of it.Including them in the suit will only cast the gun shops down there in a bad light to the uninformed.

Gun shops are already suffering over these ass nany politics. I live in a border state and can only purchase one firearm in a seven day period without filing out a multiple gun report. I can only imagine how that has hurt sales in New Mexico and Arizona and Texas.

I agree,

I also hope they rape the BATFE.... But, it is apparent to me there is a veiled effort to get the gun salesman(and guns) too. This shows the ignorance of the plaintiffs and their true intentions concerning guns. They do not like the BATFE, AND they do not like guns, gun sales, or our freedoms to own them.... Or, they would not try to exploit litigiously this gun shop owner.

I guess all I can say is the enemy of my enemy is my friend.

The only thing good that can come out of gigging the gun shop(which is really nothing) is a short term lesson, DON'T EVER HELP THE BATFE!!!!! I call it short term because they still don't deserve nor is it justfiable to sue them for the reasons WESS mentioned above. But "trusting" the government has the potential for "epic failure". Trusting the government and having it go belly up on you like this is the slow evolution we face in destroying this criminal poltico oligarchy in Washington. A hard lesson but one that reveals metaphorically that the government is bad and if you rely on them, they will fail you miserably, good people will be flushed in a system which does not police itself. We have sat on the sidelines watching this happen, now as Doc has mentioned, we may be to late to reverse it and all will suffer...

It's dispicable that the BATFE's use of this gun shop has brought this on the shop's heads. The BATFE and Holder are equally dispicable...

I also think this class action suit will probably get MORE info out of MORE criminals like Holder and his stooges because it extracts it from the clutches of the criminal politicians resolving this in "the name of public decency" and outs it in the hands of the civil court system... Can't play games and politically joust when it's outta the clutches of DC and in the public court system without bringing a more obvious attempt to hide stuff ..

You are completely right with the exception that it stops at the BATFE and Holder. I can't see how this stink doesn't go all the way up to the top.

A far as the gun shop, they were victimized just like every one else and if this thing actually goes to trial I imagine that will come to light.

The NRA has been a dark cloud over the BATFE and effective at decreasing their annual budget for some time now. Fast and Furious was their jacked up attempt at proving their worth and turning down the heat. If this suite actually happens and is successful it would be a huge blow against them and a powerful tool for all the gun rights activists. A sense of justice for the family too.

There's no guarantee on how it will affect the BATFE... To often they have risen from the ashes.... Like zombies/unread....

Hope springs eternal none the less. BATFE is a position occupied by a a long line of those whom press the stangury from politicians only to fall victim to justice and the 2nd.... Vicious cycle ay????
